Terms of Use

Access to the Services may be interrupted from time to time for maintenance, updates, technical issues, or security reasons. The Company does not guarantee that the Services will be available at all times or that access will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue all or any portion of the Services at any time, with or without notice.

To use the Services you must register as either a Seeker (someone looking to hire a service provider) or a Provider (someone offering services). You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We reserve the right to suspend, disable, or terminate any account at any time if we believe you have violated these Terms, provided inaccurate information, or otherwise created risk for the Company, other users, or the public.

Find Mobile Services is a marketplace platform that connects Seekers with identity-verified local service Providers across 12 service categories. The Company facilitates discovery and communication between users but is not a party to any agreement, transaction, or dispute between Seekers and Providers.

The Company does not employ, endorse, supervise, or guarantee any Provider. Seekers are solely responsible for evaluating Providers and making their own hiring decisions.

Providers are required to complete a Know Your Customer (KYC) identity verification process — submitting a government-issued photo ID (front and back) and a selfie — before their profile becomes visible to Seekers. KYC approval is granted at the sole discretion of the Company.

Completion of KYC verification does not constitute an endorsement, guarantee, background check, criminal history check, or professional licence verification by the Company. Seekers should exercise their own judgement when hiring.

Providers must subscribe to a paid plan to activate their listing and appear in Seeker search results. Available plans and pricing are listed in the app. Subscription payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Refunds are not provided for partial billing periods. The Company reserves the right to modify plan pricing or features with reasonable notice.

Provider listings are only visible to Seekers when the Provider's KYC status is approved, their subscription is active, and they have set themselves as available.

The Company acts solely as a neutral platform. The Company does not:

• set rates or prices between Seekers and Providers;
• guarantee the quality, legality, or outcome of any service performed;
• participate in payments between Seekers and Providers for services rendered;
• conduct criminal background checks or professional licence verification;
• supervise, monitor, or control the conduct of any Provider or Seeker; or
• assume responsibility for disputes between users.

Users may submit content including profile information, service descriptions, portfolio photos, and messages ("User Content"). You are solely responsible for all User Content you submit. By submitting User Content, you represent and warrant that: (i) all information is accurate and not misleading; (ii) you have the legal right to submit such content; (iii) it does not violate any applicable law or third-party right; and (iv) it does not contain unlawful, defamatory, obscene, or otherwise objectionable material.

We may remove, edit, or disable access to any User Content at any time, with or without notice, if we believe it violates these Terms or is otherwise inappropriate.

By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and format such content for the purposes of operating, maintaining, and promoting the Services. You retain ownership of your User Content subject to this license.

You agree not to use the Services:

• in violation of any applicable law or regulation;
• to submit false, inaccurate, misleading, or fraudulent information;
• to impersonate any person or entity;
• to post content that is defamatory, abusive, harassing, threatening, obscene, or discriminatory;
• to infringe the intellectual property, privacy, or other rights of any person;
• to interfere with, damage, or disrupt the Services;
• to introduce malware, viruses, or other harmful code;
• to use bots, scrapers, or automated tools to access or extract data from the Services without prior written permission;
• to send spam or unsolicited commercial communications; or
• to use the Services to harass, stalk, defraud, or harm any person.

Seekers may submit reviews and ratings for Providers they have engaged with. Reviews must be honest, accurate, and based on genuine experience. The Company reserves the right to remove reviews that violate these Terms or that appear to be fraudulent. Providers may not offer incentives in exchange for positive reviews.

By using the Services, you consent to receive communications from us electronically, including transactional emails (account verification, KYC status updates, subscription confirmations). You agree that electronic communications satisfy any legal requirement that such communications be in writing.

The Services and all content, features, functionality, software, trademarks, and other materials (excluding User Content) are owned by the Company or its licensors and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal use. You may not copy, reproduce, distribute, reverse engineer, scrape, or otherwise exploit any portion of the Services except as expressly permitted by these Terms.

The Services integrate third-party providers including Stripe (payments), Amazon Web Services (file storage), and Amazon SES (email). The Company does not control and is not responsible for the content, policies, or practices of these third parties. Your use of third-party services is subject to their separate terms and privacy policies.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and reliability. The Company does not warrant that the Services will be uninterrupted, error-free, or secure, or that any Provider is qualified, licensed, insured, or safe to hire.

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Services, including damages arising from Provider conduct, service quality disputes, transactions between users, or personal injury or property damage.

The Company's total liability arising out of or relating to these Terms or the Services shall not exceed the greater of (i) the total subscription fees you paid to the Company in the three months preceding the claim, or (ii) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law; (e) any dispute between you and another user; or (f) any service you performed or received through the platform.

We may suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms. You may stop using the Services and delete your account at any time. Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution provisions.

To the fullest extent permitted by applicable law, you and the Company agree that any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. The arbitration shall take place in California. Judgment on the award may be entered in any court having jurisdiction.

You and the Company each waive any right to participate in a class action lawsuit or class-wide arbitration.

You may opt out of arbitration by sending written notice within 30 days of first accepting these Terms to legal@findmobileservices.app.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to the arbitration provision above, any legal proceedings shall be brought exclusively in the state or federal courts located in California.

• These Terms constitute the entire agreement between you and the Company regarding the Services.
• If any provision is held invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.
• The Company's failure to enforce any right or provision shall not constitute a waiver.
• You may not assign these Terms without the Company's prior written consent.
• The Company shall not be liable for failures or delays caused by events beyond its reasonable control.

We may update these Terms from time to time. Changes will be effective upon posting the updated Terms in the app. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
